Informal vs. formal probate
Nebraska offers informal probate (less court supervision, common when there's a valid will and no disputes) and formal probate (more court involvement, used when there are conflicts or complications). Small estates under a statutory threshold may skip full probate with an affidavit.
The personal representative
The court appoints a personal representative (executor) who has the authority to manage estate assets — including real estate. Until someone is appointed and has "letters" from the court, no one can legally sign to sell the house.
The general timeline
- File the application and will with the county court; the PR is appointed.
- Notify heirs and creditors; Nebraska has a creditor claim period (generally a few months).
- Inventory assets, pay valid debts and taxes.
- Distribute the remaining assets and close the estate.
Most straightforward estates take several months to a year. Selling real estate can often happen during probate once the PR has authority.

Once appointed, the PR can usually sell the property, sometimes with a simple court notice depending on the type of probate and what the will authorizes.
